Accidents at work
To succeed in liability you have to be able to show that your employer failed to provide a safe place of work, a safe system of working or did not provide work equipment that was either fit for its purpose or was in some way damaged or defective.
You must also show that the employer failed to take reasonable steps to prevent the accident happening. Normally it is a question of fact in each case and there are a number of EU Regulations that employers must heed to avoid a finding of liability.
It is also possible to find the employer liable if a colleague’s negligence caused your injury. You would need to show that the colleague failed to carry out his duties in a reasonably competent manner and the negligent act was performed in the ordinary course of duties.
